The short version

1. Agreement

These Terms are between you and BeCloser LLC ("BeCloser", "we", "us"). By reserving a seat, opening a microphone link, or otherwise using the service, you agree to them. If you do not agree, do not use BeCloser.

Our Privacy Policy forms part of these Terms.

2. What BeCloser is

BeCloser lets a viewer speak, live, into a streamer's broadcast. We provide the venue: the seating, the ticket, the microphone connection and the moderation controls.

We do not run the events. Each event belongs to its streamer or organiser, who decides what it is about, who is invited, and what is acceptable in their room. They may set rules stricter than these. We are not responsible for what is said or broadcast at an event, by the organiser or by any participant.

3. Who may use it

You must be at least 13, and old enough to hold the Twitch or YouTube account you sign in with. In the EEA and the UK, under-16s need a parent or guardian's permission. You must not be barred from the service by us or by law.

4. Your seat is personal

A reservation is a personal, non-transferable licence to attend one event, tied to the account that made it.

You may not:

Your microphone link is a key to your seat. Anyone who has it can speak as you, and the moderator will see your name. Keep it to yourself — do not post it, stream it, or leave it on screen. If you lose control of it, tell the organiser so it can be revoked.

We cannot always tell who is on the other end of a link, so this clause is not a technical guarantee — it is a rule. Where we have reason to believe a seat has been sold, shared or automated, we and the organiser will act on that belief and remove it.

5. The room is public and may be recorded

Every event is a live broadcast. When you speak, you are speaking to the streamer's audience.

BeCloser does not record your audio — it passes through our relay and is gone. But the streamer is recording and publishing their broadcast, and anybody watching can record it too. Your voice and your words may be saved, clipped, re-uploaded and kept indefinitely by people we do not control.

By unmuting, you consent to your voice being broadcast, recorded and re-published as part of that event, and you waive any claim against BeCloser arising from it. If you are not comfortable with that, stay muted or leave the room — exactly as you would at any live venue.

6. House rules

Everything below applies to anything you transmit — your voice, your display name, and any audio audible through your microphone.

7. Enforcement

Moderation happens live, in the middle of a broadcast, in front of an audience. There is not time to deliberate.

We and the event's organisers may mute, remove or ban you immediately and at our sole discretion, with no prior warning and no obligation to explain — whether for breaking these rules, for breaking the organiser's own rules, or where we judge it necessary to protect the event, its audience, or the service. We may also revoke your reservation, refuse you future events, or close your account.

Removal frees your seat for someone else. Where a seat was paid for, any refund is a matter for the organiser who sold it — see section 8.

If you believe you were removed in error, write to contact@becloser.live. We will read it, but we are not obliged to reinstate you.

8. Organisers

If you run events on BeCloser, you additionally agree that you are responsible for your event: who you invite, how you moderate it, and how you handle your guests' information. You must have the rights to broadcast what happens at it, must honour these Terms in your own rules, and must comply with the terms of any platform you stream to. Any money you take for a seat is between you and your guest — BeCloser does not process payments and is not party to that arrangement.

Access keys we issue you — your admin key and each event's stream key — are confidential. Do not share them outside the people running your show, and tell us immediately if one is exposed.

9. Intellectual property

BeCloser, its name, logo, software, design and documentation belong to BeCloser LLC and are protected by copyright and trade mark law. You get a limited, revocable, non-exclusive right to use the service as intended — nothing more. You may not copy, modify, distribute, resell, reverse-engineer or create derivative works from any part of it, or remove any notice of ownership.

You keep whatever rights you have in what you say. You grant BeCloser a worldwide, royalty-free licence to transmit, relay and display it for the purpose of running the event you joined — the licence we need to carry your voice from your microphone to the broadcast, and no broader. You confirm you have the right to grant it for everything you transmit.

10. Availability

BeCloser is provided "as is" and "as available". We do not guarantee that an event will run, that audio quality will be adequate, that latency will be low, or that the service will be uninterrupted or error-free. Live audio depends on your device, your microphone and your internet connection, none of which we control. We may change, suspend or discontinue any part of the service at any time.

To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

11. Limitation of liability

To the fullest extent the law allows, BeCloser LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill or reputation, arising from your use of the service — including anything said at an event, any recording or re-publication of your voice, any act of an organiser or another guest, or any missed or disrupted event.

Our total liability to you for any claim relating to the service is limited to the greater of the amount you paid BeCloser LLC in the twelve months before the claim, or US$100.

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

12. Indemnity

You agree to indemnify BeCloser LLC against claims, damages and reasonable legal costs arising from what you transmit at an event, your breach of these Terms, or your infringement of anyone else's rights.

13. Ending your use

You may stop using BeCloser at any time and ask us to delete your account — see the Privacy Policy. We may suspend or close your account under section 7. Sections 5, 9, 11, 12 and 14 survive.

14. Governing law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules. The courts of Somerset County, New Jersey have exclusive jurisdiction, except where the law of your country of residence gives you the right to bring proceedings locally.

15. General

If any part of these Terms is found unenforceable, the rest stands. Our not enforcing a rule on one occasion does not waive it. These Terms are the entire agreement between us about the service. We may update them; material changes will be announced on the site before they take effect, and continuing to use BeCloser after that means you accept them.
